Terms of Service

1. The service

Lucid Signing lets you upload documents, request electronic signatures and store executed copies. It is operated by Bonang Technologies (“we”, “us”). By creating an account you agree to these terms on your own behalf or on behalf of the organisation you represent, and you confirm you have the authority to do so. If you do not agree with them, do not use the service.

2. Your account

You need an account to send documents (signers never need one). When you create yours, you agree to:

• Provide accurate information and keep it up to date - the email on your account is where legally significant notices go.
• Keep your credentials confidential. Actions taken through your account are treated as yours, so tell us immediately at info@lucidsigning.com if you suspect it has been compromised.
• Be at least 18 years old, or the age of majority where you live.

3. Electronic signatures

Signatures collected through Lucid Signing are electronic signatures as contemplated in the Electronic Communications and Transactions Act, 2002. You are responsible for confirming that your document type does not require an advanced electronic signature or a wet signature under applicable law - for example wills, and certain property transfers and bills of exchange.

4. Your content

You retain all rights to documents you upload. You grant us only the licence required to store, process and deliver them to your chosen recipients. You warrant that you have the right to send each document and to request signatures from each recipient.

5. Acceptable use

You agree not to use Lucid Signing to:

• Send unlawful, fraudulent or deceptive documents or signing requests.
• Impersonate another person or misrepresent a signer’s identity.
• Circumvent plan limits, token security or access controls.

6. Plans, billing and refunds

Paid plans are billed via our payment processor, monthly or annually in advance, and renew automatically until cancelled. Business plans are sold in user packs; your pack sets the maximum size of your team. You may cancel at any time and retain access until the end of the paid period. Pricing, cancellation and refunds are governed by our Billing & Refunds Policy, which forms part of these terms.

7. Service availability

We work to keep Lucid Signing available around the clock and publish live status on our status page, but no online service can promise zero interruption. Planned maintenance is announced in advance where practical. We are not liable for unavailability caused by events outside our reasonable control, including failures of networks, hosting providers or power.

8. Intellectual property

The service - its software, design, name and logo - belongs to Bonang Technologies and its licensors. These terms give you a limited, non-exclusive, non-transferable right to use it while your account is in good standing. They do not give you any right to copy, resell or white-label the service, or to use the Lucid Signing brand except as described on our brand page.

9. Termination

You may close your account at any time from Settings, under Sign-in & security. Closing it cancels any subscription and deletes your documents, signed copies, certificates and audit trail immediately - so download anything you need to keep first. If you would rather we did it, email info@lucidsigning.com and we will close it within 30 days. We may suspend accounts that breach these terms. You can also delete any individual document from your dashboard at any time, which removes its files immediately.

Documents you have already completed with other people stay in those people’s accounts. A signed agreement is their record as much as yours, and closing your account does not withdraw it from them.

10. Liability

The service is provided “as is”. To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim arose. We are not liable for indirect or consequential loss, or for the contents of documents you or your signers exchange through the service. Nothing in these terms excludes liability that cannot lawfully be excluded.

11. Changes to these terms

We may update these terms as the service evolves. If a change is material we will notify you by email or in the app at least 14 days before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms; if you do not, you may close your account before then.

12. Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them - without limiting any mandatory consumer protections that apply where you live.
